SCHÖLLY FIBEROPTIC GMBH (Company) takes the protection of personal data very seriously. We would like you to know when we save what data and how we use it. We are subject to the provisions of the European General Data Protection Regulation (EU-GDPR) and the supplementary rules of the Federal Data Protection Act (BDSG). In order to assure that the regulations concerning data protection are followed by ourselves and our external service providers, we have taken appropriate technical and organizational measures.

This data protection information is valid for our online offers. These include websites, functions and contents, as well as external online presence, such as, for example, our appearances in social media. This general data protection information also serves to inform you about the further processing of your personal data and the fulfillment of our obligation to inform you.

The terms used in this data protection information, such as, for example, person responsible or personal data are used in accordance with the definitions of the EU-GDPR. For reasons of readability and thus in keeping with the sense of an understandable transfer of information, we will not, as a rule, name the individual articles and sections.

2. General information on the processing of personal data

This Privacy Policy applies to data, including personal data, collected about you by SCHÖLLY FIBEROPTIC GMBH. Personal data is data or a combination of individual data by which you can be identified. We process your personal data in compliance with the data protection laws of the Federal Republic of Germany and the European General Data Protection Regulation. Under no circumstances will we pass on your personal data for advertising or marketing purposes to third parties outside the B. Braun Gruppe (link to B. Braun website locations), to which SCHÖLLY FIBEROPTIC GMBH belongs, without your consent.

As an international company, we use external service providers. Insofar as the processed data involves personal content, appropriate contractual agreements and organizational measures have been made in accordance with applicable law to ensure the security of your data. Our external service providers are bound by our instructions and are regularly monitored.

The use of our website is generally possible without providing personal data. Insofar as personal data (for example name, address or e-mail addresses) is collected on our pages, this is always done, as far as possible, on a voluntary basis.

We would like to point out that data transmission on the Internet (e.g. communication by e-mail) can have security gaps. We try to protect your data from unauthorized access by third parties by taking precautions such as pseudonymization, data economy, observance of deletion periods and taking into account the current state of technology. Despite these protective measures, however, we cannot completely rule out unlawful processing by third parties.

3. Data processing for accesses from the Internet

When you visit our websites, the web servers generally do not store any personal data unless you expressly consent to further processing, e.g. via the Cookie Consent Manager (point 13). (You can find more information in this privacy policy under point no. 5 "Consent").

4. Purpose of data processing

In accordance with the principle of data avoidance and data economy of the General Data Protection Regulation, we only process personal data on our website if this is either necessary for the purpose you have requested, if we are obliged to do so due to legal regulations or a contract, if we have a legitimate interest and/or if you provide it to us voluntarily.

When entering personal or business data (e.g. e-mail address, name, address), the disclosure of your data is expressly voluntary.

We process your contact, business and business-relevant data on the basis of legal regulations within the framework of the existing or developing business relationship. In addition, by entering you agree to the data entered being processed for the legitimized purpose or for the purpose named by you. Your entered data will only be processed by us for as long as the purpose requires and will be deleted after the purpose has been fulfilled or after the respective retention periods have expired. Processing for any other purpose will not take place. If you object to the processing of the data, please note that you may only be able to use our services to a limited extent.

In order to provide you with a detailed offer, your data will be transmitted and used within the B. Braun Group. The following represent ways in which we may use the data:

5. Consent

The processing of your personal data is only based on a legal permission or your consent (Art. 6 para. 1 lit. a DSGVO). Your consent to processing can be revoked at any time with effect for the future. Your consent to the processing of your personal data may be required in various cases:

  • Shipping of samples, products and information
  • Registration for contests, programs or offers at your request
  • Delivery of other services that we have offered you

6. Term of Storage

Your data will only be stored by SCHÖLLY FIBEROPTIC GMBH for as long as it is required for specific purposes. Consequently, your data will be deleted by SCHÖLLY FIBEROPTIC GMBH when:

  • The relevant legal basis for processing their data no longer exists,
  • The purpose of processing your data no longer exists,
  • You revoke your consent to the processing of your data,
  • A legal obligation makes the deletion necessary, or
  • You have objected to the processing of your personal data,

unless there are statutory retention periods. For example, the German Fiscal Code (AO) or the German Commercial Code (HGB) provide for certain retention periods. Only then may SCHÖLLY FIBEROPTIC GMBH finally delete your data. Excepted from this is data whose deletion represents a disproportionate effort. In such a case, SCHÖLLY FIBEROPTIC GMBH has a legitimate interest as defined in Art. Art. 6 para. 1 lit. f DSGVO for the storage of your data.

7. Automated decision making

For the establishment and implementation of the business relationship, we generally do not use fully automated decision-making pursuant to Art. 22 DSGVO. If we use these procedures in individual cases, we will inform you about this separately, provided this is required by law. We process your data in part automatically with the aim of evaluating certain personal aspects (profiling). We use profiling, for example, for the targeted provision of products that are of interest to you.

8. Obligation to provide personal data

Within the scope of our business relationship, you must provide the personal data that is required for the establishment and implementation of the respective business relationship and the fulfillment of the associated contractual obligations or which we are legally obligated to collect. Without this data, we will generally not be able to enter into the business relationship with you and fulfill the obligations resulting therefrom.

The website of SCHÖLLY FIBEROPTIC GMBH may contain links to the Internet pages of third parties over whose content SCHÖLLY FIBEROPTIC GMBH has no influence. After clicking on a link, you leave the area of responsibility of SCHÖLLY FIBEROPTIC GMBH. 10. Protection of minors

As a general rule, children and persons under the age of 18 do not submit personal information to us without the consent of their parents or guardians. We do not request personal data from children and we assure not to knowingly collect personal data from children, use it in any way or disclose it to third parties without authorization.

11. Transmission of data via the Internet

The Internet is a globally open platform. Due to the Internet's inherent mode of operation and the system-related risks, all data transmissions initiated by you are at your own risk. For your security, we offer our services exclusively via encrypted transmission.

12. Data transfer to third countries (non-EU countries)

We transfer your data to countries outside the European Economic Area (third countries) only to the extent that

  • it is necessary for the execution of your orders,
  • it is required by law or
  • you have given us your consent

If we transfer your data to a third country or to an international organization, this is generally done in accordance with the requirements of the GDPR. Furthermore, in accordance with the principle of data minimization, we only transfer data that is limited to the minimum necessary.

In some cases, we use service providers whose registered office, parent company or sub-service provider is located in a third country. Your data will only be transferred if the European Commission has decided that an adequate level of protection exists in a third country (Art. 45 GDPR), appropriate safeguards are in place (e.g. standard contractual clauses issued by the European Commission) and enforceable rights and effective remedies are available to you as a data subject. We have contractually regulated compliance with the European General Data Protection Regulation and its requirements with the service providers.

13. Use of cookies

Our websites also use so-called cookies. Cookies are small text files that are stored on your computer and saved by your browser. They do not cause any damage to your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, effective and secure. Some cookies (so-called "functional cookies", e.g. for language settings and ordering processes) are those that are absolutely necessary to ensure essential functions of the website. Without these, the website cannot be used as intended.

A distinction must be made between two types of cookies:

Transient cookies: Most of the cookies we use are so-called "transient cookies", in particular "session cookies". They are automatically deleted after the end of your visit. Other cookies remain stored on your terminal device until you delete them. These cookies allow us to recognize your browser on your next visit when you return to our website within the same session.

Persistent cookies: Other cookies, so-called "persistent cookies", are only automatically deleted from your end device after a specified period of time (which varies depending on the type of cookie).

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. 14. Security measures

We have taken extensive precautions to protect the security of your data. Your data transmitted to us, which you have entered e.g. in HTML pages (contact forms), are transmitted and processed in encrypted form (SSL - Secure Socket Layer) via the public data network to SCHÖLLY FIBEROPTIC GMBH.

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as requests that you send to us as the person responsible for operating the site. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL encryption is activated, the data you transmit to us cannot be read by third parties.

15. Processing of your communication inquiries

If you send us inquiries via the contact form, your data from the inquiry form including the contact data you provided there will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent. The data accruing in this context will be deleted after storage is no longer required, or processing will be restricted if there are legal obligations to retain data.

By giving us your consent when contacting us via our form, you have opted to be informed about future offers and products (e.g. newsletters, forms, etc.) from the B. Braun Group. In the course of using this portal, data may be transferred from you to the USA to a contractually bound and carefully selected service provider. The level of data protection in the USA cannot be compared with German or European standards, so adequate data protection cannot be guaranteed throughout. In order to nevertheless guarantee the security of your data as well as possible, our company takes the necessary protective measures. For example, your data is transferred to the USA according to the principle of purpose limitation and data economy, so that only the absolutely necessary information provided by you is stored.

16. Forwarding data to third parties

Your personal data will not be forwarded to third parties (i.e. outside the B. Braun Group) unless you have granted us your corresponding prior consent to do so. An exception to this is the forwarding to service providers, such as parcel service providers or shipping companies, insofar as the transfer is necessary for order processing or delivery of the goods.

The logistics service providers receive the data required for delivery for their own use. We limit ourselves to the transmission of the data necessary for the delivery.

In addition, other service providers are active for the contract initiation and contract processing, such as IT service providers or the hosting service provider for the website. These companies act for SCHÖLLY FIBEROPTIC GMBH within the framework of so-called order processing and may only use the personal data according to our instructions. SCHÖLLY FIBEROPTIC GMBH has contractually bound these service providers to the German data protection level and monitors them.

Furthermore, the transmission of data for order processing or delivery of the goods or services or for accounting and billing purposes within the B. Braun Group is excluded. Beyond this, no data will be transferred to third parties without your consent. In all these cases, the transfer is carried out in accordance with the applicable national and European data protection regulations; the scope of the data transferred is limited to the minimum required.

17. Newsletter data

If you register for an offered newsletter, you consent to the processing of your name and e-mail address as well as information that allows us to verify that you are the owner of the specified e-mail address. You also confirm that you agree to receive the newsletter.

For postal delivery, your address is also required. Your data will be processed exclusively for the requested newsletter, any further use of your data for other purposes will not take place. We will also not pass on your data to third parties. Our registration system ensures by sending a registration email with confirmation link that the selected newsletter is actually desired by you (so-called double opt-in procedure). You can revoke your consent to the processing of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter.

18. Privacy policy for Google Analytics

If you have given your consent, this website uses Google Analytics, a web analytics service provided by Google Ireland Limited. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus analyze the activities of a user across devices.

Through certification under the EU-US Privacy Shield, Google guarantees that EU data protection requirements are also met when processing data in the USA.

Google Analytics uses cookies that enable an analysis of your use of the website. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. In the event that IP anonymization is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. We would like to point out that on this website Google Analytics has been extended by IP anonymization to ensure anonymized collection of IP addresses. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

Transfer to third countries

The personal data is transferred to the USA under the so-called EU-US Privacy Shield on the basis of an adequacy decision of the European Commission. You can download the corresponding certificate here.

Duration of data storage

The data sent by us and linked to cookies, user IDs (e.g. user ID) or advertising IDs are automatically deleted after 14 months. The deletion of data whose retention period has been reached takes place automatically once a month.

You can also prevent the collection of data generated by the cookie and related to your use of the website to Google and the processing of this data by Google by downloading and installing the Browser add-on to disable Google Analytics for your browser.

A so-called opt-out cookie prevents the future collection of your data when visiting this website. However, to prevent collection across different devices, you must perform the opt-out on all devices you use. If you click here, the opt-out cookie will be set for your currently used device.

19. Privacy policy for social media

SCHÖLLY FIBEROPTIC GMBH operates its own pages on various social networks to enable an exchange with interested users or customers and to inform them about the product portfolio, solutions and knowledge of SCHÖLLY FIBEROPTIC GMBH. SCHÖLLY FIBEROPTIC GMBH itself does not process any usage data in social networks and can only evaluate and use the data anonymized by e.g. LinkedIn. This may result in data transfers of usage data to countries outside the European Union. Furthermore, the usage data collected is processed for marketing purposes, for example to define target groups and then display targeted advertising material to them on the respective social media platform. To make this possible, cookies are often stored by the social network/the respective provider of the social network, which contain the online behavior, interests, etc. of the users. Usage profiles on the respective platforms may also contain data that is stored independently of the end device. The legal basis for this type of data processing is the legitimate interest of SCHÖLLY FIBEROPTIC GMBH in a functional and stable communication with users via the respective online presence. If applicable, the providers of social media ask you for consent to the respective data processing. In this case, the legal basis for the data processing would be precisely this consent.

As a data subject of the data processing, you can assert various rights against the data controller (more information under point 23). Please note, however, that the most sensible way to exercise these data subject rights is to assert them directly against the platform provider. As a rule, only the platform providers have direct access to the processed data and are the only ones who can take appropriate measures. Of course, we are at your disposal if you have any further questions in this regard.

20. Social media plug ins

Within the internet presence of SCHÖLLY FIBEROPTIC GMBH, it may occur that third-party content is used (so-called plugins). These may take the form of YouTube videos, RSS feeds or graphics from other sites, or social media buttons such as the Share button from Facebook. If you are on a SCHÖLLY FIBEROPTIC GMBH website on which third-party content is integrated, a connection may be established with the respective social network. This allows the content of the buttons to be transmitted to your browser and integrated into the website by it. This means that the respective provider always receives the information that you have accessed the SCHÖLLY FIBEROPTIC GMBH website. 20.1 Privacy policy for the use of Facebook plugins

Plugins of the social network Facebook, provider Meta Platforms Inc. (USA) are integrated on our pages. You can recognize the Facebook plugins by the Facebook logo on our page. You can find an overview of the Facebook plugins here: http://developers.facebook.com/docs/plugins/.

When you visit our pages, a direct connection between your browser and the Facebook server is established via the plugin. Facebook thereby receives the information that you have visited our site with your IP address. This allows Facebook to assign the visit to our pages to your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its processing by Facebook. 20.2 Privacy policy for the use of Twitter

Functions of the Twitter service are integrated on our pages. These functions are offered by Twitter Inc. (USA). By using Twitter and the “Re-Tweet” function, the websites you visit are linked to your Twitter account and made known to other users. In the process, data is also transferred to Twitter. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Twitter. You can change your privacy settings on Twitter in the account settings under http://twitter.com/account/settings.

20.3 Privacy policy for the use of LinkedIn

Our website uses functions of the LinkedIn network. The provider is LinkedIn Inc (USA). Each time one of our pages containing LinkedIn functions is called up, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our web pages with your IP address. If you click the “Recommend Button” of LinkedIn and are logged into your account at LinkedIn, it is possible for LinkedIn to assign your visit to our website to you and your user account. We point out that we as the provider of the pages have no knowledge of the content of the transmitted data and its use by LinkedIn.

SCHÖLLY FIBEROPTIC GMBH uses the “Lead Gen Forms” ad format on LinkedIn. Both formats are forms already partially pre-filled with LinkedIn profile data, with which users can register for a SCHÖLLY FIBEROPTIC GMBH event or request to be contacted, for example, depending on the content of the form. Users who have filled out and sent such a form on LinkedIn are considered data subjects of the data processing and can assert various rights against the data controllers (more information under point 23). Since the form can only be submitted if the user consents to the data processing, the legal basis is "consent".

20.4 Privacy policy for the use of XING

Our website uses functions of the XING network. The provider is XING AG (Germany). Each time one of our pages containing XING functions is called up, a connection to XING servers is established. As far as we are aware, no personal data is processed in this process. In particular, no IP addresses are stored or usage behavior evaluated.

20.5 Privacy policy for the use of YouTube

Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube LLC (USA). When you visit one of our pages equipped with a YouTube plugin, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited.

If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

21. Applications 

When you apply for a job with us, the data you provide - such as your contact details and qualifications - will be used exclusively for the purpose of processing the application procedure.

Your data will be passed on internally to the responsible department heads. We process your personal data for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on the establishment of an employment relationship with us.

Furthermore, we may process personal data about you to the extent necessary to defend asserted legal claims against us arising from the application process.

Your data will generally be deleted 3 months after completion of the application process, unless otherwise agreed with the applicant (see, among other things, inclusion in the applicant pool). If your application is followed by the conclusion of an employee contract, the data will be included in the personnel file.

21.1 How long will your data be stored?

We store your personal data for as long as is necessary to make a decision about your application. Insofar as an employment relationship between you and us does not come about, we may continue to store data beyond this, insofar as this is necessary for the defense against possible legal claims. In this case, the application documents will be deleted two months after notification of the rejection decision, unless longer storage is required due to legal disputes.

21.2 Admission to the applicant pool

If we do not currently have a suitable position for your application - for example, as part of a speculative application - we will be happy to include your application in an applicant pool. However, this requires your consent, which we will request from you in such a case.

If your application documents in the applicant pool are not used by us within one year, your application documents will be automatically deleted.

21.3 No automated decision making

No automated decision is made in individual cases, i.e. the decision on your application is not based exclusively on automated processing.

21.4 Job alert

Job alert is a notification function that provides new job offers to users who have subscribed to the service. Users have the option to sign up and be notified when a new job is available in the desired category. The registration is done by double opt-in. Users can unsubscribe from the job notification by clicking on the link in the email. Processed for this purpose, the email address and job alert settings. The data is stored until the user unsubscribes from the job alert.

22. Your rights as a data subject

You have the right at any time to:

A free information about your stored personal data, their origin and recipient and the purpose of data processing as well as:

  • Correction,
  • Blocking,
  • Deletion of this data,
  • The receipt of your data in a structured, common and machine-readable format (right to data portability),
  • Revocation of your consent to the processing of your personal data,
  • Complaint to the competent supervisory authority

Objection to processing based on legitimate interest
You also have the right to object to the processing of your personal data at any time if SCHÖLLY FIBEROPTIC GMBH does so on the basis of legitimate interest (pursuant to Art. 6 (1) f DSGVO). As a consequence, the processing of your data will be stopped, unless SCHÖLLY FIBEROPTIC GMBH can justify a continuation of the processing by legal requirements or due to interests worthy of protection. This is the case, for example, if data is still required in order to be able to enforce legal claims, if necessary. 

Objection to processing for the purpose of direct marketing. You can object to the processing of your personal data for purposes of advertising and data analysis at any time (“advertising objection”). Please inform us of this via datenschutz@schoelly.de.
